SpeechMax Terms of Use

These Terms of Use (“Terms”) govern your access to and use of SpeechMax, including our website, web application, mobile application, AI speech tools, content, features, subscriptions, and related services (collectively, the “Services”).

SpeechMax is operated by AMPLIFY ACQUISITIONS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered in Poland.

By accessing or using SpeechMax, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use SpeechMax.

By using the Services, you confirm that you have the legal authority to enter into these Terms.

2. Description of Services

SpeechMax is a software platform that helps users improve their speaking skills through AI-powered feedback, speech analysis, practice exercises, learning content, and progress tracking.

SpeechMax may analyze your voice, speech patterns, pronunciation, fluency, pacing, clarity, confidence, and related communication metrics to generate feedback.

SpeechMax does not provide medical, therapeutic, psychological, or professional speech-language pathology services.

3. Account Registration

To use certain features, you may need to create an account.

You agree to:

• provide accurate and complete information;
• keep your login details secure;
• not share your account with others;
• notify us if you suspect unauthorized access;
• be responsible for all activity under your account.

We may suspend or terminate accounts that violate these Terms.

4. Subscriptions, Payments, and Billing

SpeechMax may offer paid subscriptions, plans, trials, or one-time purchases.

By purchasing a paid plan, you authorize us or our payment processor to charge your selected payment method for applicable fees, taxes, and renewal charges.

Unless stated otherwise, subscriptions renew automatically until cancelled.

You are responsible for cancelling your subscription before renewal if you do not want to be charged again.

5. Cancellation

You may cancel your subscription at any time through your account settings, payment provider, app store, or by contacting support at:

Cancellation stops future renewals but does not automatically entitle you to a refund unless you qualify under our refund policy below.

6. 30-Day Money-Back Guarantee and Refund Policy

SpeechMax offers a 30-day money-back guarantee for eligible first-time purchases.

To qualify for a refund, all of the following conditions must be met:

• You must be within your first 30 days of using SpeechMax.
• You must prove that you actively used the app during the 30-day period.
• You must submit your refund request no earlier than 7 days before your plan ends.
• Your request must be sent to info@speechmaxx.com.
• You must provide the email address associated with your SpeechMax account and any requested usage verification.

“Active use” may include completing exercises, submitting speech recordings, reviewing AI feedback, or otherwise using the core features of the app.

SpeechMax reserves the right to deny refund requests where:

• the user did not actively use the app;
• the refund request was submitted too early;
• the refund request was submitted after the eligible refund window;
• the account shows abuse, fraud, or misuse;
• the purchase was not made directly through SpeechMax.

After the first 30 days have passed, SpeechMax is not obligated to provide refunds for future renewals, continued use, subscription charges, unused time, partial billing periods, or additional purchases.

Purchases made through Apple App Store, Google Play, or another third-party platform are subject to that platform’s refund rules.

7. AI Feedback Disclaimer

SpeechMax uses artificial intelligence to generate speech feedback and recommendations.

You understand that AI-generated feedback:

• may not always be accurate;
• may not identify every issue;
• may produce incomplete or unexpected results;
• should be used for educational and informational purposes only.

SpeechMax does not guarantee that you will improve your speaking ability, confidence, pronunciation, communication skills, career outcomes, or social outcomes.

You are solely responsible for how you interpret and apply the feedback.

8. User Content and Recordings

You may submit, upload, record, or generate content through SpeechMax, including voice recordings, transcripts, written responses, and related data (“User Content”).

You retain ownership of your User Content.

By using SpeechMax, you grant us a limited license to process, store, analyze, reproduce, and use your User Content as necessary to:

• provide the Services;
• generate AI feedback;
• improve app functionality;
• troubleshoot technical issues;
• maintain safety and security;
• comply with legal obligations.

You confirm that you have the right to submit any User Content you provide.

You must not upload recordings or content involving third parties unless you have obtained any legally required consent.

9. Prohibited Use

You agree not to:

• use SpeechMax for unlawful, harmful, abusive, or deceptive purposes;
• violate another person’s privacy or intellectual property rights;
• upload offensive, illegal, or harmful content;
• reverse engineer, copy, or modify the Services;
• attempt to access SpeechMax’s source code;
• use SpeechMax to build a competing product;
• scrape, resell, sublicense, or commercially exploit the Services;
• interfere with the security or performance of the platform;
• share your account with others;
• use bots, automation, or unauthorized scripts.

We may suspend or terminate access if we believe these rules have been violated.

10. Intellectual Property

SpeechMax, including its software, design, branding, content, exercises, AI systems, user interface, logos, trademarks, and technology, is owned by or licensed to SpeechMax.

You may not copy, distribute, reproduce, modify, sell, lease, or create derivative works from any part of SpeechMax without written permission.

11. Third-Party Services

SpeechMax may use or integrate with third-party services, including payment processors, hosting providers, analytics tools, AI infrastructure providers, app stores, or communication platforms.

We are not responsible for third-party services, their availability, policies, actions, or failures.

Your use of third-party services may be subject to their own terms and privacy policies.

12. Privacy

Your use of SpeechMax is also governed by our Privacy Policy.

By using the Services, you acknowledge that we may collect and process certain personal data, including speech recordings and usage data, as described in our Privacy Policy.

13. Availability and Changes to the Services

We may update, modify, suspend, or discontinue any part of SpeechMax at any time.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We may add, remove, or change features without prior notice.

14. Disclaimer of Warranties

SpeechMax is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

We do not warrant that:

• the Services will meet your expectations;
• AI feedback will be accurate or complete;
• you will achieve specific results;
• the platform will be uninterrupted or error-free.

15. Limitation of Liability

To the maximum extent permitted by law, SpeechMax and its owners, directors, employees, contractors, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, business opportunities, or personal outcomes.

Our total liability for any claim arising from or relating to the Services shall not exceed the amount you paid to SpeechMax in the 12 months before the claim arose.

16. Indemnification

You agree to indemnify and hold harmless SpeechMax, its affiliates, directors, employees, contractors, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from:

• your use of the Services;
• your violation of these Terms;
• your User Content;
• your violation of any law;
• your violation of third-party rights.

17. Termination

We may suspend or terminate your access to SpeechMax at any time if:

• you violate these Terms;
• your payment fails;
• we suspect fraud, abuse, or misuse;
• we are required to do so by law;
• we discontinue the Services.

You may stop using SpeechMax at any time.

Termination does not entitle you to a refund unless you qualify under our refund policy.

18. Governing Law

These Terms are governed by the laws of Poland, unless mandatory consumer protection laws in your country require otherwise.

19. Dispute Resolution

Before starting legal proceedings, you agree to contact us at info@speechmaxx.com and attempt to resolve the issue informally.

If the dispute cannot be resolved informally, it shall be handled by the competent courts of Poland, unless applicable consumer law provides otherwise.

20. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you by email, in-app notice, or website update.

Your continued use of SpeechMax after changes become effective means you accept the updated Terms.
